General Terms and Conditions of Sale
1 - REMIT
These general terms and conditions of sale (hereinafter the "T&Cs") are intended to set forth the contractual relations between:
Boutiques Borde SAS, a simplified joint-stock company with share capital of 20,000 euros, incorporated on the Puy-en-Velay Trade and Companies Register under number 913 166 427, having its head office at 6 Cours du Docteur Gervais, 43170 Saugues (hereinafter "BORDE"), party of the first part,
And
Any non-commercial natural person ("You" or the "Client") wishing to make a purchase online at www.borde.fr (hereinafter the "Website"), party of the second part.
You must be at least eighteen years of age to make a valid purchase on the Website.
It is hereby reiterated that the sale of alcohol to any people under 18 years of age is prohibited. The Client undertakes, when making an order, to be at least 18 years of old as at the date of order confirmation.
Purchase of any items via the Website automatically implies unreserved acceptance of these T&Cs.
These T&Cs will prevail over all other general or special terms and conditions not explicitly approved by BORDE.
BORDE hereby reserves the right to amend these T&Cs at any time. They will be applicable immediately following publication online.
2 - PRODUCTS
All products proposed are those which appear in the catalogue published on the Website (hereinafter the "Products").These products are offered subject to availability.
The fundamental characteristics of the Products are described and presented as accurately as possible. Catalogue photographs are as faithful as possible, but no guarantee is issued regarding exact similarity to the product shown. Photographs are non-contractual and non-binding on BORDE.
Consumer protection:
- Consumption of alcohol during pregnancy may have serious and harmful effects on the child’s health;
- Sale of alcohol to people under 18 years old is strictly prohibited
- Alcohol abuse is harmful to health. Please always drink responsibly.
3 - ORDERS
3.1 - Prior identification
To place an order, you must first log in using a valid username and password.
You can either create a client account, or place an order as a guest.
3.2 - Order placement and confirmation
You can place an order online using the Website. The minimum order quantity is fixed at one Product.
Once your basket is approved, You should then choose your address and delivery method, and approve your payment method which constitutes finalisation of your sales agreement with BORDE.
Placement of an order constitutes acceptance of the Product price and descriptions available for sale.
BORDE will acknowledge receipt of your order following approval by sending an email in which You will be able to click on a link directing you towards these T&Cs.
In some instances, notably following a payment default, incorrect address or any other problem related to your account, BORDE hereby reserves the right to block your order until the problem is resolved.
3.3 - Non-availability of Products
Products are available for sale subject to availability.
In such instance as a Product is unavailable after you have already placed an order (stock availability error or other reason), We will notify you by email or telephone. We will then offer You the option of reimbursement for the missing Product(s) by bank transfer, with the remainder of the order remaining firm and definitive.

3.4 BORDE continues to own the Products ordered until full payment of the order and reserves the right to suspend delivery in the event of any late payment until total payment of the outstanding balance by the Buyer.
3.5BORDE hereby reserves the right to refuse an order or request early payment, in the event of any unpaid invoices or insolvency.
3.6 Confirmation of an order implies acceptance of these T&Cs, as well as having read these conditions in full and to waive enforcing your own terms and conditions of purchase or any others.
3.7All data provided as well as the confirmation registered constitute proof of a transaction. Confirmation constitutes valid signature and acceptance of transactions.
The seller will send an email confirmation of the order received.
4 - PRODUCT RETURNS
4.1 - Cooling-off period
In accordance with articles L.221-18 et seq of the Consumer Code, non-professional Clients (hereinafter the « Consumer ») have a cooling-off period of 14 (fourteen) clear days following the date of delivery of a Product ordered on the Website, without needing to provide justification of the grounds, nor to pay any penalties aside for return postage costs. Where this deadline expires on a Saturday, Sunday or any public holiday or non-working day, it is extended to the immediate next working day. In order to exercise this right, the Consumer should notify BORDE of its decision to retract using the form available on the Website.
The Consumer then has a period of 14 (fourteen) days following notification of its decision to retract to BORDE to return the Products concerned. As a health and safety measure, only unused Products will be accepted for returns, correctly protected, with their original packaging intact, and in perfect condition to allow them to be re-sold as new. If this deadline is not respected, no retraction will be permitted. These conditions may be accumulated and are valid for each Product returned.
4.2 - Refunds
Refunds will be made in line with the following terms:
Returns should be sent to Boutique Borde, Les Gardelles 43170 Saugues. Return costs are payable by the Consumer.
-If the package is returned in full, the order total, including “outward” shipping fees (standard postal cost) will be refunded;
-If the package is not returned in full (the Consumer withholds one or more Products ordered), the price of the Product(s) returned will be refunded alone, with the cost of the “outward” shipping fees not being refunded.
BORDE will refund the order total using the same payment method as that which the Consumer used for the initial transaction.
In accordance with article L.221-23 of the Consumer Code, the Consumer may be held liable in the event of any damage to the Products « resulting from manipulations other than those which are necessary to establish the nature, characteristics and proper operation of the goods ».
4.3 - Order cancellation
Orders cannot be cancelled, with some exceptions, where orders are already being prepared after payment approval.
5.1 For further information concerning the price, characteristics and shipping fees for Products, please contact us using the contact form available on the Website.
5.2 The price of Products appearing in the catalogue of the Website are given in Euros including tax and VAT applicable as at the date of the order; any change to the rate may be passed on to the price of Products.
Prices of products include shipping fees (shipping, packaging and parcel preparation in line with totals in force). The total amount of shipping fees will be indicated before order confirmation.
BORDE hereby reserves the right to amend its prices at any time, with it being understood that the catalogue price on the date of order will be the only price applicable to buyers.
6 - PAYMENT TERMS
Payment can be made for orders as follows:
- Bank card (CB, Visa, Eurocard/Mastercard)
- Bank transfer
- Immediate transfer (Fintecture)
- Using PayPal (by choosing to pay with PayPal, You will be automatically redirected to your PayPal account. Once your PayPal payment has been approved, You can complete your order on the Website).
7 - SHIPMENTS
Shipments are dispatched to the address indicated when a Client places an order.
Shipping costs in Mainland France are those in force as at the date of transfer of the order as appearing in the price lists applicable on the same date.
For shipments outside of Mainland France, as importer of goods, you are responsible for payment of all customs clearance fees, taxes or any other duties or fees imposed on goods upon arrival.
Delivery and shipping fees depend on the following geographical areas and the total weight of your package:
- Mainland France, Corsica and French overseas dependencies and territories
- Zone 1: Belgium, Germany, Luxembourg, the Netherlands
- Zone 2: The United Kingdom, Italy, Spain, Austria (excluding specific territories), Ireland, Portugal (excluding specific territories)
- Zone 3: Switzerland, Denmark, Estonia, Hungary, Latvia, Lithuania, Poland, the Czech Republic, Slovakia, Slovenia, Sweden
- Zone 4: Bulgaria, Cyprus, Croatia, Finland, Greece, Iceland, North Africa, Malta, Norway, Turkey, Spanish territories (Balearic Islands, Canary Islands, Ceuta, Melilla) and Portuguese territories (Madeira and Azores), other Eastern European countries, Romania
- Zone 5: The USA, China, Australia, Canada, South Korea, Hong Kong, India, Israel, Japan, Russia, Singapore, Taiwan, Thailand, Vietnam
- Zone 6: Africa (excluding North Africa), Americas (excluding the USA and Canada), the Middle East, other Asian countries, Oceania (excluding Australia)

8 - SHIPPING AND DELIVERY LEAD TIMES
8.1 - Shipping lead times
For shipments to Mainland France
COLISSIMO
- Delivery using the Colissimo service to a home address with or without signature: 2 to 3 working days* from dispatch of the order.
- Delivery using the Colissimo service to a collection point (against signature and presentation of a valid form of ID): 2 to 3 working days* from dispatch of the order.
MONDIAL RELAY
- Delivery using the Mondial Relay service to a standard collection point: 3 to 6 working days* from dispatch of the order.
Important information:
- Orders are dispatched to a relay point from Tuesday to Saturday before noon.
- Orders placed after midday on Saturday, as well as those placed on Sunday or Monday, will not be dispatched until the following Tuesday.
- The delivery time starts from the moment the order is dropped off at the delivery point.
Shipping fees are free for purchases in excess of €60, when sent by Mondial Relay and Colissimo (home delivery without signature and at collection points).
For shipments abroad
COLISSIMO INTERNATIONAL
- Colissimo delivery service to a home address with or without signature: 5 to 7 working days* from dispatch of the order.
- Delivery lead times may vary depending on the destination.
*excluding Sundays, Mondays and public holidays
In Mainland France, if you are absent when your delivery arrives, a note will be left informing you of the post office from which you can collect your delivery. Depending on where you live, a second delivery attempt may be scheduled.
You have a total of 15 days in which to collect your package from the post office before it is returned to sender.
For deliveries to a post office collection point (post office) or a retail outlet collection point (Mondial Relay), you can collect your package within:
- 10 working days from a post office
- 14 working days from a Mondial Relay collection point
9 - DISPUTES
Upon collection of your package, it is your responsibility to check the nature, quantity and condition of the Products received.
If there are any Product(s) damaged, missing, incorrect or non-compliant with your order, You can contact the shipping firm and delivery teams and contact us within 7 days following receipt of your package. You can get in touch using the contact form.
We will respond as soon as possible.
10 - MEDIATION
In accordance with articles L.616-1 and R.616-1 of the Consumer Code, we offer a consumer mediation service. The mediator we use is: CNPM – CONSUMER MEDIATION. In case of any dispute arising, you can make a claim on its website at: https://cnpm-mediation-consommation.eu or by writing to CNPM - MEDIATION - CONSOMMATION - 27 avenue de la libération - 42400 Saint-Chamond.
At European level, the European Commission provides an online dispute resolution platform (www.ec.europa.eu/consumers/odr).
11 - WARRANTY
All Products provided by our Website are covered by the statutory warranty for which provision is made under articles 1641 et seq of the Civil Code.
In the event of non-compliance of any Product sold, it may be returned to the Website which will offer to take the Product back, exchange or refund the Product.
12 - APPLICABLE LAW
These T&Cs are governed by French law.
In the event of any dispute arising from these T&Cs and use of the Website, the provisions in these T&Cs will prevail, and if these T&Cs do not include any relevant provision, French legislation shall be applicable.
Any dispute will be referred to the sole and exclusive jurisdiction of the competent court with the exception of disputes concerning natural persons and for which legal rules of jurisdictional competence are applicable.
13 - PERSONAL DATA
When placing an order, nominative data collected will be processed electronically. You are invited to have reference to the general terms and conditions of use and to the privacy policy of the Website to have further information on this issue.
